Terms of Service
1. Introduction
These Terms of Service ("Terms") govern the provision of live streaming and videography services by 3-Axis Studios / 3-Axis Live ("The Provider") to the booking party ("The Client"). By paying a deposit or booking our services, The Client agrees to be bound by these Terms.
2. Service Provision
2.1 Scope: The Provider agrees to film and live stream the funeral service at the agreed date, time, and location.
2.2 Platform: The stream will be broadcast via a dedicated link (e.g., YouTube, Facebook, or a private page). The Provider is not responsible for viewers' inability to access the stream due to their own device or data limitations.
2.3 Delivery: A digital master copy of the broadcast will be made available for download within 48 hours after the conclusion of the service.
3. Bookings & Payment
3.1 Reservation: A booking is only confirmed once a 50% deposit (or full payment, if booked within 48 hours) has been received.
3.2 Balance: The remaining balance is due 24 hours prior to the commencement of the service.
3.3 Overtime: If the service runs more than 30 minutes over the scheduled time, an additional overtime fee per hour may be billed.
4. Cancellation & Refunds
4.1 Client Cancellation
- More than 48 hours notice: Full refund of monies paid.
- Less than 24 hours notice: The 50% deposit is non-refundable (to cover reserved crew and equipment opportunity costs).
4.2 Provider Cancellation
In the unlikely event The Provider cannot perform duties due to severe illness or emergency, a full refund will be issued, and assistance will be offered to find a replacement service provider.
5. Technical Disclaimers
5.1 Internet Connectivity
The Provider utilises professional cellular bonding technology to combine multiple network signals (MTN, Vodacom, Telkom) for stability. However, mobile coverage is outside The Provider's control.
Total Blackout Protocol: In the rare event of zero cellular signal at the venue (e.g., remote graveside), The Provider will record the service in high definition and upload it immediately upon reaching a signal area. This is deemed a full execution of the service.
5.2 Power Cuts
The Provider is equipped with battery backup for all cameras and streaming units. The stream will continue during power cuts. However, The Provider is not liable if the venue's lights or PA system fail due to power cuts.
5.3 Environmental Factors
The Provider is not liable for compromised audio quality caused by extreme wind, heavy rain, or interference from the venue's own sound system.
6. Copyright & Music
6.1 Music Rights: The Provider does not own the rights to music played during the service.
6.2 Platform Blocking: Streaming platforms (YouTube/Facebook) use automated algorithms to detect copyrighted music.
⚠️ Important Warning
If copyrighted music is played loudly at the venue, the platform may mute sections of the audio or block the video entirely.
Liability: The Provider is not liable for stream interruptions caused by third-party copyright algorithms. We recommend using royalty-free music or keeping music volume low during the broadcast.
7. Privacy & POPIA Compliance
7.1 Consent: By booking the service, The Client confirms they have the authority to allow filming of the deceased and attendees.
7.2 Data Usage: The Provider will not sell or share client data. Footage is stored securely and deleted from local drives after 30 days, though the online stream may remain available at the Client's request.
7.3 Right to Withdraw: Attendees have the right to request not to be filmed. It is The Client's responsibility to notify attendees of the live stream.

8. Limitation of Liability
8.1 To the maximum extent permitted by South African law, The Provider shall not be liable for any indirect or consequential loss (including emotional distress) arising from a technical failure of the stream.
8.2 The Provider's total liability for any claim shall be limited to the total value of the package paid by The Client.
9. Force Majeure
The Provider is not liable for failure to perform duties due to acts of God, civil unrest, riots, strikes, or extreme weather conditions that make travel to the venue unsafe or impossible.
