By accessing our website or booking our services, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.

2. Use of the Website

2.1 Permitted Use

You may use our website for lawful purposes only, including browsing our services, submitting enquiries, and making booking requests. You agree not to:

Use the website in any way that violates applicable South African or international laws or regulations.
Transmit unsolicited or unauthorised advertising or promotional material.
Attempt to gain unauthorised access to our systems, servers, or databases.
Interfere with or disrupt the integrity or performance of the website.
Use automated tools (bots, scrapers, crawlers) to extract content without our written consent.
Impersonate any person or entity or misrepresent your affiliation with any person or entity.

2.2 Accuracy of Information

We strive to keep the information on our website accurate and up to date. However, we make no warranties or representations regarding the completeness, accuracy, or timeliness of any content. Pricing, availability, and service descriptions are subject to change without notice.

3. Services and Bookings

3.1 Booking Requests

Submitting a booking request through our website does not constitute a confirmed booking. A booking is only confirmed once we have responded in writing (email) to confirm availability and agreed on the details with you. We reserve the right to decline any booking request at our discretion.

3.2 Quotes and Pricing

All quotes provided via our website or email are valid for 14 days from the date of issue unless stated otherwise. Prices are quoted in South African Rand (ZAR) and are inclusive of VAT where applicable. Final pricing may vary based on the scope of work, duration, location, and any additional requirements agreed upon.

3.3 Payment Terms

Unless otherwise agreed in writing:

A non-refundable deposit (typically 50% of the agreed fee) is required to secure your booking date.
The remaining balance is due on or before the date of the service, or as specified in your service agreement.
Payment methods accepted will be communicated at the time of booking confirmation.
Late payments may attract interest at the rate permitted under the National Credit Act or as agreed in your service agreement.

3.4 Cancellations and Rescheduling

Cancellation and rescheduling policies are as follows unless otherwise specified in your service agreement:

More than 14 days before the event: Deposit is forfeited; no additional charges apply.
8–14 days before the event: 75% of the total fee is payable.
7 days or less before the event: 100% of the total fee is payable.
Rescheduling: One rescheduling is permitted at no charge if requested more than 14 days in advance and subject to availability. Subsequent changes may incur an administration fee.

3.5 Studio Rental

Studio rental bookings are subject to additional studio-specific terms, including but not limited to:

Clients are responsible for any damage to studio equipment or property caused during their session.
The studio must be vacated at the agreed end time. Overtime will be charged at the applicable hourly rate.
Food and beverages are permitted only in designated areas of the studio.
Smoking, vaping, and open flames are strictly prohibited on studio premises.
A technician or studio supervisor may be present during your session.

4. Intellectual Property

4.1 Our Content

All content on this website — including text, images, videos, logos, graphics, and the overall design — is owned by or licensed to 3-Axis Studios and is protected by South African and international copyright laws. You may not reproduce, distribute, modify, or create derivative works from our content without our express written permission.

4.2 Deliverables and Usage Rights

Unless otherwise agreed in writing, the following applies to content we produce for you:

3-Axis Studios retains copyright in all footage, photographs, and produced content.
Upon full payment, we grant you a non-exclusive licence to use the final deliverables for personal or commercial purposes as agreed.
We reserve the right to use final deliverables in our portfolio, website, and marketing materials unless you request otherwise in writing prior to the commencement of the project.
Raw footage, unedited files, and behind-the-scenes material remain the property of 3-Axis Studios and are not included in deliverables unless specifically agreed.

4.3 Client-Supplied Materials

By providing us with any materials (logos, images, music, video clips, etc.) to incorporate into your project, you warrant that you have the right to use those materials and that doing so will not infringe any third-party intellectual property rights. You indemnify 3-Axis Studios against any claims arising from such materials.

5. Limitation of Liability

To the maximum extent permitted by applicable law:

3-Axis Studios shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website or services.
Our total liability to you for any claims arising from a service agreement shall not exceed the amount paid by you for that specific service.
We are not liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control (force majeure), including but not limited to acts of God, load shedding, civil unrest, or government restrictions.

Nothing in these Terms limits liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.

6. Indemnity

You agree to indemnify and hold harmless 3-Axis Studios, its directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or in connection with your use of our website or services, your breach of these Terms, or your infringement of any third-party rights.

7. Third-Party Links

Our website may contain links to third-party websites. These links are provided for your convenience only. We do not endorse or take responsibility for the content, privacy practices, or terms of any third-party websites. Accessing third-party sites is at your own risk.

8. Privacy

Your use of our website and services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our website, you consent to the collection and use of your information as described in our Privacy Policy.

9. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from or in connection with these Terms or our services shall be subject to the exclusive jurisdiction of the courts of South Africa.

In the event of a dispute, both parties agree to first attempt to resolve the matter through good-faith negotiation. If unresolved after 30 days, the matter may be referred to mediation before litigation is pursued.

10. Changes to These Terms

We reserve the right to update or modify these Terms at any time. Changes will be effective immediately upon posting to this page with a revised "Last updated" date. Your continued use of our website or services after such changes constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.

11. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision shall be severed from the remaining Terms, which shall continue in full force and effect.

12. Entire Agreement

These Terms, together with our Privacy Policy and any specific service agreement entered into with you, constitute the entire agreement between you and 3-Axis Studios regarding your use of our website and services, and supersede all prior communications and agreements.

13. YouTube & Third-Party Integrations

Our staff booking and operations portal, 3AxisLivestreams, integrates with YouTube API Services to create and manage the live broadcasts we produce on 3-Axis Studios' own YouTube channel. By using the YouTube livestream features of this portal, you agree to be bound by the YouTube Terms of Service. Our use of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements, and is described further in our Privacy Policy.
